New Township Fireworks Ordinance

Due to Recent Changes by the State Legislature the Township is Revising the Township's Fireworks Ordinance.

PUBLIC NOTICE

Notice is hereby given that the Board of Supervisors of North Coventry Township, Chester County, PA at the regularly scheduled meeting on the 9th day of July, 2018, at 7:00 PM shall hold a Public hearing to consider and may adopt a new Fireworks Ordinance that is summarized below:

The Ordinance revokes the prior Fireworks Ordinance of North Coventry Township and, in its place, amends Chapter 185 of the Code of Ordinances of North Coventry Township revising in full the Ordinance to comply with Act 43 of 2017 (“Act”).  It provides for definitions and regulates the use, sale and storage of consumer fireworks, prohibiting certain activities and uses of fireworks in accordance with the Act as well as federal regulations.  It also provides for the sale of consumer fireworks in temporary structures for the storage and sale of consumer fireworks.  There are also provisions regulating the display of fireworks, requiring permits and regulating use thereof.  The possession and use of display fireworks by persons over the age of 21 by permit and for specific activities is allowed.  The permittee for display fireworks must be bonded in a sum no less than $50,000 conditioned on the payment of all damages which may be caused to a person or property because of display fireworks arising from the act of the permittee, agent, employee or subcontractor of the permittee.  There are provisions for the extension of the permit.  The Ordinance also contains provisions for granting permits for agricultural purposes.  It also provides for authority for confiscation of materials that are offered or exposed for sale, stored or held in violation of the Ordinance.  Additionally, the Ordinance provides for penalties, repeals all ordinances conflicting with the provisions of the proposed Ordinance and provides for the Ordinance to become effective as provided by law.
