Obtaining “Party Status” & Public Comment
During the hearing, the Zoning Hearing Board Solicitor will open the floor for requests for party status.
Any person who has made a timely appearance of record before the Zoning Hearing Board (ZHB) and believes they are affected by the application may request party status. The ZHB will grant party status only to persons who demonstrate a legally sufficient interest, or “standing,” under applicable law, including Section 908(3) of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10908(3).
The Applicant may object to a person’s standing, and the ZHB will ultimately determine whether that person qualifies for party status.
Party status is different from public comment. A person who is granted party status has the right to be represented by counsel and may respond to the application, present evidence and arguments, call witnesses, and cross-examine adverse witnesses on relevant issues.
A person who does not obtain party status may still participate in the hearing as a member of the general public. However, general public comment is permitted only after the ZHB, Applicant, and any parties have entered their exhibits and presented their witnesses, evidence, and arguments.
